Welcome to OYUKIO! These Terms and Conditions (“Terms”) govern your use of our website (www.oyukio.com), our services, and the Ring Customization Tool. OYUKIO is a project operated by Tjep., a design studio registered under the laws of the Netherlands with its principal place of business at Veembroederhof 204, 1019HC Amsterdam, Netherlands. As OYUKIO does not currently have its own independent legal status, all rights, obligations, and liabilities under these Terms are held and enforced by Tjep. By accessing or using our site or services, you agree to be bound by these Terms with Tjep. as the governing entity. If you do not agree, please do not use our site or services.
1. Eligibility
You must be at least 18 years old to use our website or purchase products from OYUKIO. By using our services, you confirm that you meet this requirement and are legally capable of entering into binding agreements.
2. Products and Orders
Custom-Made Products: All rings offered by OYUKIO, including those designed via the Ring Customization Tool, are custom-made to order. Tjep., operating as OYUKIO, does not hold stock due to the extensive combinations of perfect ring sizes, materials, and possible customizations available, unless explicitly stated otherwise on the product listing.
Availability: Product availability is subject to our capacity to produce custom orders. We reserve the right to discontinue or modify product offerings without notice.
Pricing: Prices are listed in [insert currency, e.g., EUR] and exclude shipping costs and applicable taxes, which will be calculated at checkout. We may update prices at any time.
Order Acceptance: Your order is an offer to purchase, which Tjep., operating as OYUKIO, may accept or reject at its discretion. We’ll confirm acceptance via email.
3. Payment
Payments are due at checkout and accepted via featured payement methods.
Failure to complete payment may result in order cancellation. All transactions are final once processed, subject to our refund policy.
4. Shipping and Delivery
Shipping costs and estimated delivery times are provided at checkout. Tjep., operating as OYUKIO, aims to dispatch custom-made orders promptly but is not liable for delays caused by production timelines, carriers, or unforeseen circumstances.
Risk of loss transfers to you upon delivery.
5. Returns and Refunds
Custom-Made Products: Due to the bespoke nature of OYUKIO rings and the fact that we do not hold stock because of the many combinations of perfect ring sizes, materials, and possible customizations, all custom-made products, including those designed via the Ring Customization Tool, are non-returnable and non-refundable except in cases of manufacturing defects or errors attributable to Tjep., operating as OYUKIO (e.g., incorrect materials or specifications not matching your order). If a defect or error is confirmed, you must notify us within 7 days of delivery, and we will, at our discretion, repair, replace, or refund the defective item. Return shipping costs for defective items will be covered by Tjep.
Stock Models (If Applicable): In the rare event that Tjep., operating as OYUKIO, offers a pre-made, in-stock ring (explicitly designated as such on the product listing), you may return it within 14 days of delivery, provided it is unused, in its original condition, and in its original packaging. Refunds for stock models, if approved, will be processed within [insert time, e.g., 10 business days] to your original payment method. Shipping costs for such returns are non-refundable unless the return is due to our error.
Process: To initiate a return, contact us at [insert email, e.g., support@oyukio.com] with your order details and reason for return. Custom-made items cannot be resold due to their unique nature and our no-stock policy, and thus no returns are accepted outside the exceptions noted above.
6. Ring Customization Tool Usage and Rights
The Ring Customization Tool provided by OYUKIO is offered as a creative service for users to design custom rings. Use of this tool does not grant the user any special rights, ownership, or intellectual property claims over the designs created, beyond the right to purchase the physical ring as a product from Tjep., operating as OYUKIO, subject to our standard terms of sale.
No copyright or intellectual property rights are conferred to the user as a result of using the Ring Customization Tool. Any designs generated through the tool remain the intellectual property of Tjep., operating as OYUKIO, and users may not assert copyright claims or pursue legal action against Tjep. based on the output of the tool. Tjep., operating as OYUKIO, shall not be liable for any claims of copyright infringement brought by the user, their clients, or third parties arising from the use of the tool or the resulting designs. Users acknowledge that they are solely responsible for ensuring their use of the tool does not infringe on the rights of others, and Tjep. is not obligated to verify or enforce such compliance. By using the Ring Customization Tool, you represent and warrant that any designs, ideas, or elements you input into the tool are original to you and do not incorporate pre-existing intellectual property owned by you or any third party unless you have explicit permission to use such material.
Tjep., operating as OYUKIO, reserves the unrestricted right to publish, display, or reproduce any ring designs created via the Ring Customization Tool for promotional, marketing, or other purposes at our discretion. We value your creativity and aim to use these designs responsibly to showcase the possibilities of our tool. Additionally, Tjep., operating as OYUKIO, reserves the right to incorporate any designs generated through the tool into our permanent collection or product offerings, without obligation to provide compensation, credit, or notice to the user.
By using the Ring Customization Tool, you agree to these terms and waive any right to pursue legal action against Tjep., operating as OYUKIO, for claims related to intellectual property, copyright infringement, or the use of designs created through the tool.
7. Intellectual Property
All content on our website (e.g., images, text, logos) is owned by Tjep., operating as OYUKIO, or our licensors. You may not reproduce, distribute, or use it without our written consent, except as permitted by law.
8. Limitation of Liability
To the fullest extent permitted by law, Tjep., operating as OYUKIO, is not liable for indirect, incidental, or consequential damages (e.g., lost profits) arising from your use of our site, services, or products. Our total liability shall not exceed the amount you paid for the product in question.
9. Dispute Resolution
